Delay of over two years in uploading Patna HC judgment since its pronouncement, SC asks high court registrar to submit report

Surprised by the inordinate delay of 733 days between the pronouncement of a judgment by the Patna High Court on January 28, 2018, and its uploading on the court website on May 1, 2019, the Supreme Court last week directed the Registrar General of the Patna High Court to submit a report on whether it is indeed true, and the reasons for the same.

“There is an inordinate delay of 733 days as stated by the learned counsel (not 333 days as set out in the application and the office report). This aspect to be verified by the Registry”, the bench of Justice Sanjay Kishan Kaul and Dinesh Maheshwari said.

A division bench of Patna High Court on January 28, 2018, dismissed an appeal filed by the State Government challenging the order of a single judge quashing an order of the Government ending the engagement of one Raj Kumar Yadav as a Chowkidar.

The single judge had directed the State Government to consider petitioner for regularization in the work-charged establishment under the respondents. However, the State unsuccessfully contested the order before the division bench which dismissed its appeal on January 28, 2018

The matter ultimately reached the Supreme Court when it noticed the inordinate delay between the pronouncement of the judgment and its uploading on the website.
