How to Avoid Parents and Family Arrest under 498A?

Once FIR is filed under 498a, police usually dont convey the notice and directly came in night and make arrest. Most of the time they come on friday night to Men’s family should not get bail till monday night. BTW police arrest is not mandatory

1. One has 2 keep an eye on d bitter half’s movements & try 2 get d FIR info asap 2 apply 4 AB.

2. You can inform the local PS also abt her desertion & get d application acknowledged.

3. Move 2 a new addr. Also u & ur parents can stay in separate places 4 some time.

4. Finally remember getting arrested is NOT d end of d world. Watever happens DON’T panic. Very soon u all will get bail & d cases against ur parents cud b easily quashed.

5. You can go for AB even FIR is not filed. At least you should get notice bail for parents.

What is notice bail that will avoid arrest?

Notice bail is a pre arrest notice. It means polcice will give some specifc days notice to your parents before arrest. For eg. if you get 7 days pre arrest notice from the court. In this case police will come and will say we will arrest you after 7 days. In the mean time you can again apply for Anticipatory bail in the court and avoid arrest after 7 days.

So Notice bail is something where police will come and will say we can arrest you after these number of days based on what you get from the court.
