If your employer has not paid your Full and Final Settlement (FnF) after resignation or termination, you have legal rights. Here’s what you can do:
✅ Step 1: Send a Written Request
Write a formal email or letter to HR/Accounts requesting your FnF dues — including salary, leave encashment, bonus, gratuity (if applicable), etc.
✅ Step 2: Check Company Policies & Exit Terms
Ensure you’ve served your notice period or paid in lieu of it. If you’ve complied with all terms, they are legally bound to clear your dues.
✅ Step 3: Send a Legal Notice
If your written request is ignored, send a legal notice through a labor lawyer demanding your payment within a stipulated time.
✅ Step 4: File a Complaint
You can:
- Approach the Labour Commissioner in your region.
- File a complaint with the Labour Court under the Payment of Wages Act or Shops & Establishment Act (India).
- For amounts over ₹20 lakhs, consider the civil court route.
✅ Step 5: Approach Ministry Portals (India)
File a complaint online at https://samadhan.labour.gov.in or https://pgportal.gov.in.
2. What to Do If Falsely Accused of a Crime (Theft/Harassment)?
Being wrongly accused is serious — but you have rights under law:
🛡️ Step 1: Stay Calm & Contact a Criminal Lawyer Immediately
Do not respond emotionally or confront the accuser. Let a legal expert guide you.
🛡️ Step 2: Collect Evidence in Your Favor
Gather emails, call logs, CCTV footage, chat records, or witness support to prove your innocence.
🛡️ Step 3: File a Counter-Complaint
If the accusation is false and malicious, file a counter FIR for:
- False allegations (Section 182 IPC)
- Defamation (Sections 499/500 IPC)
- Criminal intimidation (Section 506 IPC)
🛡️ Step 4: Apply for Anticipatory Bail
If you fear arrest, apply for anticipatory bail under Section 438 CrPC.
🛡️ Step 5: Right to Fair Trial
You are presumed innocent until proven guilty. Do not give any statement to the police without legal representation.
