Under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, a senior citizen or parent can seek maintenance from their children or relatives through a simple legal process.
Process under the Senior Citizens Maintenance Act:
Filing an Application
- A senior citizen or parent can file an application for maintenance before the Maintenance Tribunal established by the State Government.
- The application can be filed personally or through an authorized person or organization on their behalf.
Notice to Children or Relatives
After receiving the application, the Tribunal issues a notice to the children or relatives against whom maintenance is claimed.
Both parties are given an opportunity to present their arguments.
Inquiry by the Tribunal
Maintenance Order
If the claim is proved, the Tribunal may order the children or relatives to pay a monthly maintenance amount to the senior citizen.
The Act provides for a maximum maintenance amount as prescribed by the government.
