Under Section 356 of the Bharatiya Nyaya Sanhita (BNS), 2023, a person may commit defamation by making or publishing an imputation concerning another person with the intention, or knowledge/reason to believe, that it will harm that person's reputation. The provision is broad and is not limited to newspapers or public social-media posts.
When a WhatsApp message may be defamatory
For example, if someone posts in a WhatsApp group:
“ABC is a thief and has stolen money from the company.”
and the allegation is false, identifies ABC, and is communicated to other group members in circumstances that harm ABC's reputation, it could potentially constitute defamation.
Factors that may be important include:
