If you have received a defamation notice in India, do not ignore it or respond emotionally. A legal notice is generally an opportunity to respond before the matter potentially proceeds further.
What should you do after receiving a defamation notice?
Read the notice carefully
Check exactly what statement, post, video, comment, or publication is alleged to be defamatory. Note the date, platform, people involved, and demands made in the notice.
Preserve all evidence
Keep screenshots, URLs, messages, emails, documents, recordings, photographs, and other material connected with the statement. Do not delete or alter potentially relevant evidence.
Do not make further statements about the dispute
Avoid arguing with the sender on social media or posting additional comments that could create another allegation of defamation.
Consult a lawyer
Ideally, have a lawyer experienced in defamation matters review the notice and the evidence before you respond. The lawyer can determine whether the allegations have a legal basis and whether any statutory exceptions or defences apply.
Check whether your statement has a possible defence
Under Section 356 of the Bharatiya Nyaya Sanhita, 2023 (BNS), defamation generally concerns an imputation made or published with the intention, knowledge, or reason to believe that it will harm a person's reputation. The provision also contains exceptions, including certain statements concerning truth and public good, good-faith opinions, and substantially true reports of court proceedings.
Send an appropriate reply
Depending on the facts, your reply might deny the allegations, explain the context, rely on supporting evidence, request clarification, offer a correction or retraction where appropriate, or reject the demands. Do not admit liability merely because you received a notice.
Take the deadline seriously
If the notice gives you a specific period to respond, give it to your lawyer immediately. Missing the deadline can make the situation more difficult, even though a notice itself is not the same thing as a court judgment.
