Yes. In India, WhatsApp chats can be used as evidence in a money recovery case, particularly when the messages show that the person borrowed money, acknowledged the debt, promised to repay it, or discussed the outstanding amount.
Payment screenshots can also support your claim, but screenshots and chats alone may not always be enough. The court will consider the complete evidence, its authenticity, and whether it establishes that the money was a loan rather than a gift or payment for another purpose.
What evidence should you preserve?
- WhatsApp chats: Messages in which the borrower admits receiving the money or promises repayment.
- Bank or UPI records: Statements and transaction receipts showing when and how much you transferred.
- Original chat history: Keep the conversation on your phone and export it where appropriate. Avoid deleting or editing messages.
- Additional documents: Any written acknowledgment, repayment schedule, email, SMS, or record of partial repayment.
- Electronic evidence requirements: Electronic records must comply with the applicable evidence rules, including requirements under the Bharatiya Sakshya Adhiniyam, 2023, where applicable.
What if you have no other documents?
You may still be able to pursue a recovery claim using WhatsApp chats, especially if the messages clearly identify the amount borrowed and the borrower's promise to repay. However, the court will assess whether the messages are genuine and sufficient to establish the debt. Section 63 of the Bharatiya Sakshya Adhiniyam, 2023, may apply to electronic copies or printouts.
