The family of \nthe retired honorary captain of Indian Army who hails from Kolohikas \nvillage in Kamrup district of Assam had approached the High Court for \njustice on May 31.\n<\/p>\n\n\n\n<p>He is currently lodged at the Goalpara detention camp in Assam.\n<\/p>\n\n\n\n<p>The court ordered his release on the condition that he has to \nfurnish a bail bond of Rs 20,000 with two local sureties. The order \nfurther states that upon his release from detention on bail, he cannot \nmove out of the territorial jurisdiction of Kamrup and Kamrup (Metro) \ndistricts without prior information and approval of the Superintendent \nof Police (Border), Kamrup. \n<\/p>\n\n\n\n<p>The court also directed that prior to releasing him on bail, the \nauthorities shall obtain the biometrics of Sanaullah that includes the \niris scan of both eyes and fingerprints of both hands.\n<\/p>\n\n\n\n<p>A group of six lawyers represented Sanaullah in court today &#8211; \nSenior Advocate Indira Jaising, assisted by Advocates Hafiz Rashid Ahmed\n Choudhury, PK Deka, Aman Wadud and Syed Burhanur Rehman. After hearing \nthe arguments of Senior Advocate Indira Jaising, Judges Manojit Bhuyan \nand Prasanta Kumar Deka granted interim bail to Sanaullah. \n<\/p>\n\n\n\n<p>\u201cInvestigation should be fair. No genuine citizen should \nunnecessarily be targeted in the name of detection of illegal migrants. A\n group of 6 lawyers, 3 paralegals and the entire nation\u2019s blessings were\n with Sanaullah today. I can\u2019t explain the feeling,\u201d said Guwahati-based\n Advocate Aman Wadud who has done a number of pro bono work in such \ncases.\n<\/p>\n\n\n\n<p>Days after he was detained, the Assam police had discharged \nSanaullah from service \u2013 he had been serving as Sub-Inspector of Border \nPolice at the Baihata Chariali police station under Kamrup rural \ndistrict after his retirement from Army. Ironically, Assam Border Police\n is tasked with detection, detainment and deportation of doubtful \ncitizens and illegal migrants.\n<\/p>\n\n\n\n<p>The respondents \u2013 the state government and the Centre, NRC \nauthorities and Assam Border Police have been directed to respond to the\n petition within four weeks. The Investigating Officer of Border Police,\n Chandramal Das has also been made a respondent in his personal \ncapacity. \n<\/p>\n\n\n\n<p>Earlier, three separate FIRs were lodged against the retired \nSub-Inspector of Assam Police (Border) by three persons who were tagged \nwitnesses in Sanaullah\u2019s case. The FIRs stated that they had not given \nany statement or signed any document as witnesses. \n<\/p>\n\n\n\n<p>\u201cThis type of incidents happen in Assam due to the lack of border\n security. The district Superintendent of Police has a lot of duties \u2013 \nadministrative, law and order among other responsibilities  overlapping \nhis border duties. So, if the government does not wish to repeat the \ncase of Sanaullah, a separate border wing of police should be set up in \nevery district, and the SP(Border) should independently look after this \nissue of detection of illegal migrants,\u201d said Abhijeet Sharma of the \nAssam Public Works (APW) and petitioner in the National Register of \nCitizens (NRC) case in the Supreme Court.\n<\/p>\n\n\n\n<p>\u201cThere is no seriousness in work, lack of manpower, and lack of nation sentiments,\u201d Sharma added.\n<\/p>\n\n\n\n<p>Meanwhile, Sanaullah\u2019s family heaved a sigh of relief and welcomed the court\u2019s order.\n<\/p>\n\n\n\n<p>\u201cWe are eagerly awaiting his return home,\u201d said Ajmal Hoque, \nSanaullah\u2019s cousin and retired army JCO Azmal Hoque, who had also served\n the nation for three decades. \n<\/p>\n\n\n\n<p>During his military career of thirty years, Sanaullah had taken  part in three Counter Insurgency operations while being posted with 26  Rashtriya Rifles in Doda district of Jammu and Kashmir and 33 Field  Workshop in Kupwara near Line of Control (LoC) from 2015 to 2017.
