{"id":4884,"date":"2019-07-06T13:40:08","date_gmt":"2019-07-06T13:40:08","guid":{"rendered":"http:\/\/www.wakilsahab.in\/news\/?p=4884"},"modified":"2019-07-06T13:40:08","modified_gmt":"2019-07-06T13:40:08","slug":"cbfc-has-no-intellectual-morality-to-decide-what-people-can-watch-bombay-high-court","status":"publish","type":"post","link":"https:\/\/www.wakilsahab.in\/news\/cbfc-has-no-intellectual-morality-to-decide-what-people-can-watch-bombay-high-court\/","title":{"rendered":"CBFC has no intellectual morality to decide what people can watch: Bombay High Court"},"content":{"rendered":"\n<p>Source: theprint.in<\/p>\n\n\n\n<p><strong>Mumbai:<\/strong>&nbsp;\u201cAre you ostriches,\u201d an angry Bombay High Court bench Friday asked the censor board for refusing to issue a universal (U) certificate to a children\u2019s film and asserted the board will \u201cnot decide what one wants to watch and see\u201d.<\/p>\n\n\n\n<p>In strongly-worded observations, a division bench of justices S C Dharmadhikari and Gautam Patel also said that it may have to redefine the role of the Central Board of Film Certification (CBFC) entirely as the latter thinks that it was the \u201conly one with an iota of intelligence to decide for everyone\u201d.<\/p>\n\n\n\n<p>The bench was hearing a petition filed by the Children\u2019s Film Society (CFS), India, seeking directions to the CBFC tribunal to hear its plea to issue universal certificate to its film \u201cChidiakhana\u201d.<\/p>\n\n\n\n<p>In January, the board issued universal\/adult (U\/A) certificate to the film, owing to an abusive word and a particular scene in it.<\/p>\n\n\n\n<p>The Society has claimed that the film is meant for children and is to be screened in schools.<\/p>\n\n\n\n<p>It said it is willing to remove the two objections.<\/p>\n\n\n\n<p>The bench said the CBFC, by asking for such scenes to be deleted in films, was pretending that these issues do not exist.<\/p>\n\n\n\n<p>\u201cAre you (CBFC) ostriches? Put your head in the sand and pretend something does not exist,\u201d Justice Patel said.<\/p>\n\n\n\n<p>The CBFC Friday told the court that it has laid down certain conditions and if those are fulfilled then the film will be given \u2018U\/A\u2019 certificate.<\/p>\n\n\n\n<p>Irked with this, the high court asked how can the board say that it will give \u2018U\/A\u2019 certificate irrespective of whether the scene and abusive word is deleted.<\/p>\n\n\n\n<p>\u201cWe actually wonder if the CBFC officials have children of their own. You (CBFC) are a certification board and not a censor board. You will not decide what one wants to watch and see,\u201d Justice Patel said.<\/p>\n\n\n\n<p>\u201cNobody has given you (CBFC) the intellectual morality and authority to decide what one wants to watch and see,\u201d he added.<\/p>\n\n\n\n<p>The bench further said that the world was changing and so was the art of storytelling.<\/p>\n\n\n\n<p>\u201cLooks like we may have to redefine your (CBFC) role entirely. You (CBFC) are forming an opinion that the whole population is infantile and imbecile and you are the only one with an iota of intelligence to decide for everyone,\u201d Justice Patel said.<\/p>\n\n\n\n<p>The court said when a children\u2019s film shows or speaks about issues like racism, discrimination, child labour and drug abuse, then it is better to use the films to explain these issues to children.<\/p>\n\n\n\n<p>\u201cHow else does one show and explain these issues to a child?
