{"id":5329,"date":"2019-07-22T13:05:45","date_gmt":"2019-07-22T13:05:45","guid":{"rendered":"http:\/\/www.wakilsahab.in\/news\/?p=5329"},"modified":"2019-07-22T13:05:45","modified_gmt":"2019-07-22T13:05:45","slug":"plea-to-declare-chanting-of-jai-shri-ram-a-fundamental-right-dismissed-by-calcutta-hc","status":"publish","type":"post","link":"https:\/\/www.wakilsahab.in\/news\/plea-to-declare-chanting-of-jai-shri-ram-a-fundamental-right-dismissed-by-calcutta-hc\/","title":{"rendered":"Plea to declare chanting of Jai Shri Ram a fundamental right dismissed by Calcutta HC"},"content":{"rendered":"\n<p>Source: theleaflet.in<\/p>\n\n\n\n<p><strong>THE<\/strong>&nbsp;Calcutta High Court has dismissed a public interest petition seeking to declare the worship of Lord Rama and the chanting of&nbsp;<em>\u201cJoy Sree Ram\u201d (Jai Shri Ram)&nbsp;<\/em>a fundamental right.<\/p>\n\n\n\n<p>Citing an incident that had occurred on\u00a0May 30, 2019\u00a0in Bhatpara, 24 Paragana, West Bengal, where seven people were arrested for chanting\u00a0<em>Joy Sree Ram\u00a0<\/em>while Chief Minister Mamata Banerjee\u2019s motorcade was passing through, the Public Interest Litigation (PIL) petition filed by an advocate Partha Ghosh, had alleged that in detaining the accosters, the state authorities had imposed curbs on the right of a community to freely profess and propagate their religion. Ghosh had pegged his writ petition on the FIR that is said to have been registered against the seven persons to allege a fundamental rights violation.<\/p>\n\n\n\n<p><em>\u201c<\/em>We are amazed at the manner in which this writ petition is filed seeking a declaration that it is part of fundamental right of a citizen to worship Lord Rama and to chant \u201cJoy Sree Ram\u201d, a division bench comprising Justices Thottathil B Radhakrishnan and Arijit Banerjee said on July 12, 2019 in reference to the petitioner\u2019s use of the FIR to support his writ petition.<\/p>\n\n\n\n<p>\u201cThe cause of action, which is attempted to be projected to sustain this writ petition, is an FIR stated to have been lodged or prayed to be lodged by S.I. Bhim Chandra Patra, Bhatpara I.C. under Jagaddal P.S., BKPC, reporting a particular incident\u2026If an FIR is registered and if due investigation and enquiry discloses any cognizable offence, law will take its due course.
