margin: 0px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; touch-action: manipulation;\">New Delhi:<\/span>\u00a0Controversial preacher Zakir Naik&#8217;s Islamic Research Foundation (IRF) on Friday moved the Delhi High Court challenging a tribunal&#8217;s order upholding the Centre&#8217;s decision to ban the organisation under Unlawful Activities Prevention Act (UAPA).<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">The matter came up for hearing before a bench headed by Acting Chief Justice Gita Mittal, who recused herself and directed that IRF&#8217;s appeal is listed before another bench.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">The matter has now been listed before another bench on 27 July.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">While seeking setting aside of the ban imposed on it, the IRF in its plea has contended that the &#8220;tribunal erred in observing that there is material indicating communal riot because of the speech made by Naik&#8221;.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">A special tribunal on 11 May had upheld the Centre&#8217;s decision to ban IRF, saying there were sufficient reasons, including posing a threat to India&#8217;s security, to declare it an unlawful association.<\/p>\n<div id=\"avAdDiv\" style=\"box-sizing: border-box; margin: 0px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 14px;\"><\/div>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">The IRF sought setting aside of the 11 May verdict and said that the tribunal has wrongly decided the question on the liability of the organisation in view of the alleged action of Naik and his aide Arshi Qureshi.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">&#8220;It failed to appreciate that it was an undisputed position that Naik is the president of the IRF, but the same could not reflect upon the action carried out by him in his individual capacity,&#8221; the IRF&#8217;s plea filed through advocate S Hari Haren said.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">The organisation said that actions done by individuals named in the FIRs cannot reflect on the organisation and will affect the charitable and educational work being done by it.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">The tribunal, headed by Justice Sangita Dhingra Sehgal of Delhi High Court, had found that Naik has failed to take part in the legal proceedings before it and was &#8220;absconding and untraceable&#8221;.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">The tribunal on 23 February had ordered in-camera hearing in view of the confidential material being scrutinised by it.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">Upholding the Centre&#8217;s 17 November, 2016 notification banning IRF for five years, the tribunal had said that there were sufficient reasons and cause to declare IRF an unlawful association.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 15px; padding: 0px; -webkit-font-smoothing: subpixel-antialiased; font-family: 'Frank Ruhl Libre', Georgia, serif; touch-action: manipulation; font-size: 1.5em; line-height: 1.75em;\">On 16 March, a single-judge bench of the Delhi High Court had also held that the Centre&#8217;s decision to ban the IRF was taken to safeguard national security.
