The Delhi High Court on Tuesday sought the response of the Aam Aadmi Party\ngovernment, the police and the Election Commission after a petition challenged\na Rs 10,000 fine levied on an auto-rickshaw driver for displaying an \u201cI love\nKejriwal\u201d poster on his vehicle, PTI reported.<\/p>\n\n\n\n
The driver, identified as Rajesh, was penalised on January 15 for the\nposter, according to Hindustan Times<\/em>. Rajesh said he was not asked to\nput up the poster by any political party, and claimed he did it on his own last\nyear. The driver claimed the traffic police fined him while he was on his way\nfrom Kalindi Kunj to Apollo Hospital. In his petition, Rajesh said the police\nviolated his fundamental right, and urged the court to set aside the penalty.<\/p>\n\n\n\n The lawyer representing the government and the police sought some time from\nthe court to examine why Rajesh was fined, and promised to file a status report\non the matter. The Election Commission\u2019s counsel said the driver might have\nbeen fined because of alleged violation of the Model Code of Conduct. The\npetitioner\u2019s advocate argued that the poster was not a political advertisement,\nand pointed out that it was put up at the driver\u2019s expense. The case will be\nnext heard on March 3.<\/p>\n\n\n\n Meanwhile, Delhi Chief Minister Arvind Kejriwal lashed out at the Bharatiya\nJanata Party, asking it to stop targeting the poor. \u201cThe BJP through its police\nis targeting poor auto drivers using false challans,\u201d he tweeted. \u201cHis only\nmistake is that he has written \u2018I love Kejriwal\u2019. Such maliciousness against\nthe poor is not right. I appeal to the BJP to stop taking revenge against the\npoor.\u201d<\/p>\n
