New Delhi: <\/strong> The Supreme Court asked a Delhi BJP leader today to approach its mentioning officer to get an early date for hearing of his plea seeking the removal of hundreds of anti-citizenship law protesters occupying a road-stretch in Delhi’s Shaheen Bagh area.<\/p>\n\n\n\n BJP leader Nand Kishore Garg has urged the top \ncourt for an urgent hearing, considering the difficulty faced by \nresidents due to the nearly-two-month-long protest on a road connecting \nDelhi and Noida. Also, various other arterial roads of Delhi have been \nfacing traffic congestion due the protest.<\/p>\n\n\n\n Restrictions have been \nimposed on the Kalindi Kunj-Shaheen Bagh stretch and Okhla underpass \nsince December 15, when hundreds of women sat on a protest against the \namended law.<\/p>\n\n\n\n “You go to the mentioning officer,” the SC bench headed by Chief Justice SA Bobde told Mr Garg.<\/p>\n\n\n\n Saying\n that the law-enforcement machinery has been “held hostage to the whims \nand fancies of the protesters,” the plea has sought laying down of \nguidelines for protests leading to obstruction of public place.<\/p>\n\n\n\n “It\n is disappointing that the state machinery is muted and silent spectator\n at hooliganism and vandalism of the protesters who are threatening the \nexistential efficacy of the democracy and the rule of law and had \nalready taken the law-and-order situation in their own hand,” said the \nplea.<\/p>\n\n\n\n It said the Shaheen Bagh \nprotest is “undoubtedly within the constitutional parameter” but it has \nlost its legality as constitutional protections were being “blatantly \nand brazenly flouted and violated.”<\/p>\n\n\n\n The State has a duty to \nprotect the fundamental rights of its citizens, who have been facing \ntrouble due to the road blockade, it said.<\/p>\n\n\n\n “Hence, it is urgently \nrequired that the public places must not be allowed to be abused and \nmisused for ulterior and mala fide purposes such as staging protest \nagainst the constitution amendment in the heart of the capital city and \nthereby causing incalculable hardships and difficulties to the common \npeople,” it said.<\/p>\n\n\n\n It said a similar plea was filed by another \nlitigant in the Delhi High Court, which on January 14 directed the local\n authority to deal with the situation. The litigant has filed an appeal \nin the top court against the high court order and sought supervision of \nthe situation in Shaheen Bagh by a retired Supreme Court judge or a \nsitting judge of the Delhi High Court.<\/p>\n
