{"id":9570,"date":"2020-02-05T07:42:03","date_gmt":"2020-02-05T07:42:03","guid":{"rendered":"http:\/\/www.wakilsahab.in\/news\/?p=9570"},"modified":"2020-02-05T07:42:03","modified_gmt":"2020-02-05T07:42:03","slug":"karnataka-hc-upholds-senior-designations-of-18-advocates","status":"publish","type":"post","link":"https:\/\/www.wakilsahab.in\/news\/karnataka-hc-upholds-senior-designations-of-18-advocates\/","title":{"rendered":"Karnataka HC upholds Senior Designations of 18 Advocates."},"content":{"rendered":"\n<p>Source:- barandbench.com<\/p>\n\n\n\n<p>The\n Karnataka High Court recently dismissed petitions challenging the \ndesignation of 18 lawyers as Senior Advocates in November 2018.<\/p>\n\n\n\n<p>A Division Bench of Chief Justice<strong>Abhay Shreeniwas Oka <\/strong>and Justice <strong>Mohammad Nawaz <\/strong>also looked into the constitutionality of the <em>High Court of Karnataka (Designation of Senior Advocates), Rules, 2018 <\/em>(Senior Designation Rules) which were issued pursuant to the Supreme Court&#8217;s judgment of <em>Indira Jaising v. Supreme Court of India. <\/em>In this regard, the Court held,<\/p>\n\n\n\n<p><em>&#8220;If\n any of the Rules&#8230;framed by the High Court of Karnataka is either \ninconsistent or contrary to the directions issued by the Apex Court in \nthe case of Indira Jaising (supra), either the same will have to be read\n down or will have to be ignored and the process of designation of the \nAdvocates as Senior Advocates must be commenced and carried out strictly\n in terms of the directions of the Apex Court.&#8221;<\/em><\/p>\n\n\n\n<p>In\n this regard, Rule 11, which gives finality to the views of the Chief \nJustice, was held to be contrary to the decision of the Supreme Court.<\/p>\n\n\n\n<p>It was also held that the scope of judicial review of decisions of the Full Court in the designation process was limited.<\/p>\n\n\n\n<p><em>&#8220;When\n a writ Court is called upon to exercise its power of judicial review \nunder Article-226 of the Constitution of India against the decision of \nthe Full Court, it cannot go into the merits of the decision and it can \nexamine only the decision making process.&#8221;<\/em><\/p>\n\n\n\n<p>The petition was filed by four lawyers \u2013<strong> Puthige R Ramesh, MH Sawkar, Ganesh Krishna Bhat<\/strong>, and <strong>BL Acharya<\/strong> \u2013 on the ground that the designations were made in an arbitrary and irrational manner. Another petition was filed by Advocate <strong>TN Raghupathy.<\/strong><\/p>\n\n\n\n<p>Among  the issues raised were that several provisions of the Senior  Designation Rules framed by the High Court have been violated in the  recently conducted designation process, that the process was concluded  in a hasty manner after two judges of the High Court were recommended for transfer by the Supreme Collegium, and that the Rules do not contemplate for cut-off marks for the applicants, as was done in this case.<\/p>\n\n\n\n<p>Allegations\n that less deserving lawyers had been designated as Senior Advocates and\n apprehension of bias on the part of then Advocate General <strong>Udaya Holla<\/strong>, part of the Permanent Committee for designations, were also raised.<\/p>\n\n\n\n<p>After\n considering all arguments, the Court held that there was no reason to  \ninterfere in the designations made in November 2018.<\/p>\n\n\n\n<p>However, the Court took a dim view that one of the designees, <strong>Lakshmy Iyengar<\/strong>, made certain allegations against Senior Advocate <strong>BV Acharya<\/strong>, who is the father of one of the petitioners.<\/p>\n\n\n\n<p>The\n petitioners had claimed that Iyengar, who secured the maximum marks in \nthe designation process, has only eight reported judgments to her name, \nas opposed to other more experienced lawyers.<\/p>\n\n\n\n<p>On her part, Iyengar\n claimed that Acharya was involved in unethical propaganda against her \nby making phone calls to several Senior Advocates. She also alleged that\n the senior lawyer spread the rumour that she had granted sexual favours\n to ensure her designation.<\/p>\n\n\n\n<p>The Court, however, noted that \nabsolutely no attempt was made to substantiate the said allegations. In \nthis light, the Court recommended that her designation be reviewed by \nthe Full Court.<\/p>\n\n\n\n<p>&#8220;More\n so when after giving an opportunity to withdraw the allegations against\n the Senior Advocate, the same were not withdrawn by her. Therefore, we \nare of the view that her case needs to be considered by the Full Court \nfor review or recall in accordance with the directions of the Apex Court\n contained in paragraph 73.11 in the case of Indira Jaising (supra).&#8221;<\/p>\n\n\n\n<p>Karnataka High Court<\/p>\n\n\n\n<p>Further,\n the Court upheld the point-based system and held that the cases of all \ncandidates were duly considered by the Full Court. The Court also \ndismissed concerns regarding the transfer of Justice <strong>Raghvendra Chauhan<\/strong>, who was then part of the Full Court that signed off on the designations.<\/p>\n\n\n\n<p>The\n Bench also held that the Full Court is not bound by the overall \nassessment or points\/marks assigned by the Permanent Committee.
