The Madhya Pradesh government had exempted women and children up to 12 years from wearing helmets while riding two-wheelers. <\/p>\n\n\n\n<p>The Madhya Pradesh government told the high court on Monday that it \nwill soon withdraw the exemption to women and children up to 12 years \nfrom wearing helmets on two-wheelers.<\/p>\n\n\n\n<p>This was stated by \nadditional advocate general of Madhya Pradesh Praveen Dubey before a \ndivision bench of MP high court in Jabalpur during a hearing on a \npetition filed by a law student, Himanshu Dixit, in 2019 challenging the\n relaxation given to women and children up to 12 years from wearing a \nhelmet while riding two-wheelers as is required under the Motor Vehicles\n Act. Following the petition, the high court had issued notices to the \nstate government in October 2019. <\/p>\n\n\n\n<p>The petitioner had contended \nthat the relaxation given to women and children was violative of the \nConstitution\u2019s Articles 14, 15(1) and 21 and also defeated the purpose \nfor use of helmet that was made mandatory for two- wheeler riders under \nthe Motor Vehicles Act, 1988.<\/p>\n\n\n\n<p>He has said only Sikh community \nmembers are exempted from wearing helmet as per a provision in Motor \nVehicles Act but at the same time there is a mention in the provision \nthat the state government if wishes so can relax the provision for any \ngroup or community.
