NRIs or Non indian citizens who are getting married to Indian brides in India and if you dont have any properties in India then always get married as per Special marriage act,1954.If you wish to have religious ceremony, then have it only after having civil marriage(also known as register marriage) under Special marriage act,1954 and once you get marriage certificate from sub registrars office.

I have seen here many people getting confused with various laws which are applicable to Indian marriages. Below brief might help them when they are getting married.

1. Hindu Marriage Act,1955 : To get married or to register marriage under Hindu marriage Act , both of them i.e bride and bride groom should be Hindus.

After having the religious ceremony, couple has option to register their marriage with the concerned govt authority ( eg sub registrars office )as per Hindu marriage Act or Special marriage Act ,1954

2. Christian marriage Act,1872 : To register marriages or to get married under Christian marriage act at least one of them must be a Christian.

After having the religious ceremony in the church couple has option to register their marriage with the concerned govt authority ( eg sub registrars office ) as per Christian marriage Act or Special marriage Act ,1954

3. The Muslim Personal Law (Shariat) Application Act,1937 :
To get married or to register marriage under this act both of them should be Muslims.

After having the religious ceremony in the mosque couple has option to register their marriage with the concerned govt authority ( eg sub registrars office )as per Muslim Personal Law (Shariat) Application Act or Special marriage Act ,1954

4. Special marriage Act,1954 : Any body irrespective of caste, religion, region, nationality can get married under this act.This is also called civil marriage or court marriage. If i am right just for the maximum sum of Rs 150 or 200 couple can get married under this act with out any religious ceremony. People from same religion too can get married under this act

Note : Goa is the only state which has uniform civil code i.e same law irrespective religion or caste. So above various religious laws are not applicable in Goa.Special marriage act is applicable in Goa but it is not applicable in the state of Jammu and kashmir.

Personally my opinion is couple who wish to settle out side India or in USA its better to have civil marriage as per special marriage act first. Its one month procedure. Once you get the marriage certificate then if you wish you can have religious ceremony as per traditions of your religion.

Non indian citizens marrying indian citizens always get married under special marriage act . never ever get married or register your marriage under any of the above religious laws.Once you get the marriage certificate then if you wish you can have religious ceremony as per traditions of your religion
